Union pipe fitter gets $6,1 million compensation for mesothelioma

Mesothelioma lawyers at the firm Clapper, Patti, Schweizer & Mason successfully litigated claim for financial compensation on behalf of Franklin Ham. Mr. Ham is retired union pipe fitter with developed pleural mesothelioma as a consequence of constant exposure to asbestos on his working places in Northern California and Nevada.
The settlement was agreed with all but one of the companies he worked with totaling 3,5 million dollars. And company which didn’t agree to terms of settlement must pay 2,6 million dollars to Mr. Ham. As earlier mentioned all companies except one agreed to settlement.
The company that didn’t agree a Nevada insulation supplier is an inactive corporation so they thought they could they could get away with it but that wasn’t the case because under the laws of both California and Nevada, an insurer of an inactive corporation is still liable for the harm caused by the corporation during its active years, even if the harm does not become apparent until the corporation has become inactive.
Let us just hope that Mr. Ham still has enough time to spend his hardly earned fortune.

UK Government plans to act on mesothelioma claims

Lord Falconer, Secretary of State for Constitutional Affairs and Lord Chancellor along with John Hutton Secretary of State for the Department of Works and Pensions putted forward proposals to help mesothelioma victims receive adequate compensation. New legislation will be forwarded in order to fix all negative things concerning the system of making claims that involve more than one negligent employer.
Lord Falconer among other things pointed: "The Government is acting quickly to help claimants suffering from this terrible disease to receive the compensation to which they are entitled as soon as possible. I intend to bring forward an amendment to the Compensation Bill to provide that in these cases negligent employers should be jointly and severally liable, so that the claimant can recover full compensation from any relevant employer. It would then be open to that employer to seek a contribution to the damages awarded from other negligent employers."
This will surely bring a better chance for just and full compensation for thousands of people that suffer from mesothelioma and all because they were exposed to asbestos at work. Although this isn’t and couldn’t be as good as health itself, this will at least give victims and their families some kind of compensation for the lost health.
